Resolution of the Executive Committee of the Arizona State Republican Party State of Arizona Strongly Condemning the Actions of the Arizona Independent Redistricting Commission (AIRC)
WHEREAS, the Arizona Independent Redistricting Commission has knowingly violated its responsibilities for redistricting under Federal and Arizona law including, but
not limited to, the Fourteenth and Fifteenth Amendments to the United States
Constitution, the Voting Rights Act, 42 U.S.C.A. 1973, et seq.; and Article 4
of the Arizona Constitution; and
WHEREAS, the Arizona Independent Redistricting Commission has failed to demonstrate a sincere commitment to performing its responsibilities in an honest, independent and impartial fashion and to upholding public confidence in the integrity of the redistricting process; and
WHEREAS, the Arizona Independent Redistricting Commission has knowingly violated its responsibilities for conducting open meetings to the public under Arizona law
including, but not limited to, Title 38 of the Arizona Revised Statutes; and
WHEREAS, the Arizona Independent Redistricting Commission has knowingly violated itsprocurement responsibilities to the public under Arizona law including, but not
limited to, Title 41 of the Arizona Revised Statutes.
NOW THEREFORE BE IT RESOLVED by the Executive Committee of the Arizona State Republican Party, State of Arizona, strongly condemns the partisan actions of the Arizona Independent Redistricting Commission and recommends the following:
1. That Governor Jan Brewer, State of Arizona, remove the five members of the Arizona Independent Redistricting Commission in accordance with Article 4 of the Arizona Constitution;
2. That Attorney General Tom Horne, State of Arizona, aggressively continue his criminalinvestigation and civil litigation against the Arizona Independent Redistricting Commission;
3. That the Majority Leadership of the Senate and House of Representatives, State of Arizona, make written redistricting recommendations to the Arizona Independent Redistricting Commission in accordance with Article 4 of the Arizona Constitution that are in the best interest of the State of Arizona, not the Commission’s favored special interest groups. Recommendations that eliminate the wholesale gerrymandering of Arizona and hijacking of the voters’ constitutional and democratic rights guaranteed under both the Equal Protection Clause of the 14th Amendment and the Voting Rights Act.

The federal government filed a lawsuit Monday seeking to stop implementation of South Carolina’s tough new immigration law, arguing that the legislation that requires law officers to check suspects’ immigration status is unconstitutional.
Federal officials and state officials had met to discuss the issue a week ago.
The government wants a judge to stop enforcement of the legislation, which requires that officers call federal immigration officials if they suspect someone is in the country illegally following a stop for something else, U.S. Attorney Bill Nettles told The Associated Press.
“The Department of Justice has many important tasks,” Nettles said. “Two of those important tasks are the defense of the constitution and ensuring equality is afforded to all.”
The lawsuit filed in federal court names Gov. Nikki Haley as a defendant. A spokesman for the Republican, the daughter of immigrants from India, said the state was forced to pass its own law because there is no strong federal immigration law.

Gov Jan Brewer: Flags at Half-Staff in Honor of Fallen Army Soldier Michael D. Elm – “I am heartbroken that another true Arizona hero has lost his life. On Friday, October 14, Army Spc. Michael D. Elm, 25, of Phoenix, was killed while working in the line of duty in Khowst, Afghanistan. Spc. Elm was overseas supporting Operation Enduring Freedom when insurgents attacked his unit with an improvised explosive device. He died thereafter of wounds suffered from the attack. Spc. Elm was assigned to the 1st Battalion, 26th Infantry Regiment, 3rd Brigade Combat Team, 1st Infantry Division, and was based in Fort Knox, Kentucky. I have ordered that all state flags be flown at half-staff from sunrise until sunset on Monday, October 31, in honor of fallen Army soldier Spc. Michael D. Elm.”
Even harshest critics call bar association case ‘gross overcharging’

It is in this atmosphere that a case has developed in Arizona that is blasting a former prosecutor and two associates for their attempts to follow the book and apply the law to actions by the systems power brokers as well as others.
It is so egregious that it has even the former prosecutor’s harshest critics are saying that the overreaching “gives credence to [Andrew] Thomas’ claim that he is the victim of a witch hunt.”
That was from columnist Robert Robb, who has made made no display of supporting Thomas.
“I have written scathingly about the gross abuse of power by former County Attorney Andrew Thomas and Sheriff Joe Arpaio,” he said. “Thomas and Arpaio proclaimed that there was a giant conspiracy involving the county board of supervisors, senior county management and several judges in which the judges agreed to protect county officials against criminal probes in exchange for the county constructing a new office building for the judges.”

Congressman Trent Franks (AZ-02) today expressed his support for Governor Jan Brewer’s inquiry into the Independent Redistricting Commission’s handling of the redrawing of Arizona’s voting districts: “The Independent Redistricting Commission as constructed is a fatally flawed political architecture. Rather than bringing the people’s voice and bipartisanship to the process of drawing legislative and congressional district lines as originally presented to the public, it has brought confusion, political duplicity and a blatantly unjust result.”
