ATTN: CANDIDATES AND CAMPAIGN WORKERS – Political Signage in Easements
During this time of year it is not uncommon to see political signage on all corners of many busy intersections. What many people may not know is that placing these signs into the ground is considered excavation by the standard of the AZ State Law Title 40, Chapter 2, Article 6.3, Section 40-360.21.
The law defines excavation as: “any operation in which earth, rock or other material is moved, replaced or otherwise displaced by means or use of tools, equipment or explosives and includes, without limitation, grading, trenching, digging, ditching, drilling, augering, boring, tunneling, scraping, cable or pipe plowing or driving.”
Many of the signs have been spotted with sharp spikes directly over gas distribution, telecommunication and power facilities. Often facilities are assumed to be located at a depth greater than the sign will be planted. However many factors influence how deep a facility actually is and the depth should never be assumed. From a safety perspective, planters of political signs must be educated as to the process for having the facilities located prior to placing them into the ground.
The process is simple, free and the law. It requires that the Arizona Blue Stake Center be notified 2 full business days before the excavation is to take place. A phone call to 602-263-1100 in Maricopa County or dialing 8-1-1 or 1-800-STAKE-IT (782-5348) from anywhere in the state will allow all owners/operators of underground facilities to either locate and mark or let you know there is no conflict with their facilities.
Making contact with an electric or gas line can cause serious injury. Many times damages to facilities occur without an immediate impact to life or property. However, those damages can create problems years later. The bottom line is the process is easy, the call is free and it is one of the laws that help keep Arizona citizens safe.
Please educate all of your staff that “plant” those signs to follow this process in advance of their activities. If there are any questions, please do not hesitate to contact me directly.

Governor Issues Executive Order to Continue Moratorium on Regulatory Rule Making PHOENIX – Governor Jan Brewer today issued an Executive Order to continue the moratorium on regulatory rule making for state agencies. Governor Brewer’s first official action upon taking office in January 2009 was to institute a moratorium on all new rule making by state agencies in order to avoid costly, burdensome and unnecessary rules. The moratorium was subsequently continued for FY 2009-10 by HB 2008 in the 2009 Third Special Legislative Session.
HB 2260, as signed by the Governor in the 2010 Second Regular Legislative Session, continues the rule making moratorium for FY 2010-11. The effective date of HB 2260 is July 29, 2010, thereby leaving a gap in the moratorium for July 1, 2010 to July 29, 2010. The Governor’s Executive Order insures that the rule making moratorium will remain consistent.
The Governor’s Office grants exceptions for changes to rules that create efficiencies, cost savings, benefit public safety and health, and reduce burdens on business. Before engaging in any changes to regulatory rules, agencies must consult with the Governor’s Office for approval.
Franks’ Response to President Obama’s Immigration Address: July 1, 2010 — Responding to President Obama’s address on immigration today, Congressman Trent Franks (AZ-02) released the following statement: “It is clear after today’s speech that this Administration is not one to let something as pesky as the truth get in the way of a good sound bite.
“In his remarks, President Obama criticized Arizona’s recently enacted immigration law, SB 1070, claiming that such laws put ‘huge pressures on local law enforcement.’ In fact, SB 1070 exists only because the federal government has for years refused to do its job, enforce federal law, and secure our southern border. Indeed, SB 1070 does the opposite of what the President accuses– in the absence of federal action, it finally frees up local law enforcement to do the job the federal government won’t do.
“The President also repeated the tired claim that SB 1070 allows police officers to make stops based solely on a person’s race in order to inquire about immigration status. The reality is that the law explicitly prohibits such profiling, only allowing police officers to inquire about immigration status in the process of another ‘lawful stop, detention or arrest . . . in the enforcement of any other law or ordinance.’
“Finally, the President’s failure to adequately address what must be the foundation of any truly effective immigration reform, particularly in a post-9/11 world– and that is border security. As many as 40% of those crossing the border illegally are actually from countries other than Mexico. The President and his Administration seem to fail to understand what terrorists do understand– that our southern border provides the easiest means of smuggling a nuclear or other WMD into the United States, only one of which would be enough to hold an entire American city hostage.
“Any immigration plan that doesn’t put border security first is no immigration plan at all.”
Franks Introduces Legislation to Protect Critical Uranium Mining in AZ from Obama Administration Ban July 1, 2010 – Congressman Trent Franks (AZ-02) today, along with 30 other Members of the House, introduced H.R. 5665, bipartisan legislation that would prevent uranium mining in Arizona from being banned by the Obama Administration. Uranium is the key natural resource necessary to produce nuclear energy, and Arizona is home to the most significant uranium deposits in the United States. Interior Secretary Ken Salazar has announced the Administration’s intention to withdraw these lands from mineral entry, thereby making the U.S. even more dependent on foreign countries and worsening an already serious vulnerability in America’s national security.
Franks stated, “Considering President Obama’s call for the construction of additional nuclear power plants, it is astonishing to me that the Administration would nevertheless move to ban uranium mining in the most significant known uranium ore reserves in America. Currently, over 90% of our operating reactors receive their uranium supply from foreign countries, many of whom are unfriendly to America and unsympathetic to American interests.
“By prohibiting exploitation of northern Arizona reserves, the Obama Administration strategically weakens America’s long-term national security and our ability to be energy self-sufficient. It also seriously calls into question President Obama’s supposed commitment to increase our domestic nuclear energy production in order to protect America’s national security.”
According to the U.S. Geological Survey, northern Arizona reserves total 326 million pounds or enough uranium to power the entire state of Arizona for 79 years. Arizona deposits range from 0.7 % to 3% grade uranium—by far the best quality reserves anywhere in the continental U.S.
In 1984, Congress passed the Arizona Wilderness Act, which specifically recognized the uranium potential of 490,000 acres of BLM lands and 50,000 acres of Forest Services lands by releasing them from wilderness study classification so they could be mined. The bill was a collaborative effort that included the mining and livestock industries, the National Parks Conservation Association, the Wilderness Society, and the Sierra Club. To this day, uranium mining activities on these lands have a record of productive operation and successful reclamation without impacting the environment or National Parks.
Message from AZ GOP Chairman Randy Pullen: The Usual Suspects – The Arizona Republic and Arizona Democrat Party have teamed up again. Phoenix: Last month, Republic reporter Daniel González authored a front page story attempting to link the passage of SB 1070 and Arizona Republican Party’s ability to attract voters. According to Arizona Republican Party Chairman, the story was a blatant example of shoddy reporting, or worse yet, shows a willingness to supply the ink for Democrat distortions or flat out fabrications when it comes to illegal immigration.
“The reports of our demise has been greatly exaggerated,” said Chairman Pullen. “The Arizona Secretary of State’s numbers indicate that Republicans have out registered Democrats by more than 2-1 since April 19th. The Democrat Party’s claim they were registering 500 Latino voters was either completely false or shows how out of touch with voters in Arizona they truly are. Unfortunately, the Republic choose to move forward with a story that was flawed from the start. While we all understand the Republic’s stance on amnesty and illegal immigration, I am disappointed that they wouldn’t observe the slightest hint of journalistic integrity.”
On June 29th, Arizona Secretary of State Ken Bennett issued a press release announcing that Republicans added 7,852 voters bringing the total to 1,116,643 active, registered voters in Arizona. During that same period, Democrat registration climbed by only 3,879 to reach 1,005,665 registered voters. With 500 Latino registrations a week, that would leave only 879 other statewide registrations. A fact that has not yet been clarified or investigated in the Arizona Republic.
“Around the country the Republican Party is experiencing a resurgence,” said Pullen. “Plus, a national Gallup poll has indicated that Independent voters are trending Republican. In Arizona, we just learned that for the first time in state history, Republican voters outnumber Democrats in Graham County. In Pinal, Republicans are poised to surpass Democrats very soon. In Maricopa County, people are leaving the Democrat Party while the Republican Party is growing. The hard work of our grassroots volunteers is beginning to pay off and we are moving towards a fantastic election day where we will see the results of all our efforts.”
“We’ve worked really hard here in Graham County to enroll people as Republicans,” said Graham County Chairman John Rhodes. The credit really goes to our precinct committeemen, candidates and county leadership who have gone door-to-door to register our friends and neighbors. Arizonans are frustrated with Democrats inability to lead and make the tough decisions. We are really excited to see our part of the state go from blue to red for the first time since statehood, and look forward to seeing more counties do the same!”
