You’ll be pleased to know that the “under God” part of the Pledge of Allegiance is still legal — but just barely:

SAN FRANCISCO (AP) – A federal appeals court in San Francisco upheld the use of the words “under God” in the Pledge of Allegiance and “In God We Trust” on U.S. currency, rejecting arguments on Thursday that the phrases violate the separation of church and state.

The 9th U.S. Circuit Court of Appeals panel rejected two legal challenges by Sacramento atheist Michael Newdow, who claimed the references to God disrespect his religious beliefs.

“The Pledge is constitutional,” Judge Carlos Bea wrote for the majority in the 2-1 ruling. “The Pledge of Allegiance serves to unite our vast nation through the proud recitation of some of the ideals upon which our Republic was founded.”

The same court ruled in Newdow’s favor in 2002 after he sued his daughter’s school district for forcing students to recite the pledge.

Commerceby Michael Boldin

For decades, using a tortured definition of “interstate commerce,” Congress has claimed the authority to regulate, control, ban, or mandate virtually everything – from wheat grown on one’s own land for personal consumption, to weed grown in an individual’s own home for the same purpose, to guns manufactured, sold and kept in state boundaries.

Today, Dave Freudenthal, the Democrat Governor of Wyoming Governor stood up and gave a resounding NO to this by signing into law House Bill 95 (HB0095), the Firearms Freedom Act. Wyoming joins Montana, Tennessee and Utah as the fourth state to make the act law.

The bill states:

A personal firearm, a firearm action or receiver, a firearm accessory, or ammunition that is manufactured commercially or privately in the state to be used or sold within the state is not subject to federal law or federal regulation, including registration, under the authority of congress to regulate interstate commerce.

The bill easily passed the House and the Senate passed it unanimously, by a vote of 30-0.

The Obama Justice Department administration shut down an investigation into ACORN last year, ignoring evidence of fraud at the community group, a government watchdog claimed Thursday, citing investigative documents it obtained.

The watchdog, Judicial Watch, in releasing the documents, accused ACORN of “evident criminal conduct” and suggested that Obama’s past ties to ACORN played a role in the investigation’s conclusion.

ACORN responded by emphasizing that it was cleared of wrongdoing, though the federal investigation found problems with how the organization hires and trains employees.

The investigation stemmed from complaints made in 2008 by two Republican officials in Connecticut. In Stamford, Republican Registrar Lucy Corelli said her office rejected 300 of 1,200 ACORN voter registration cards because of “duplicates, underage, illegible and invalid address,” causing $20,000 in extra work. In Bridgeport, Republican Registrar Joseph Borges said an ACORN drive “produced over 100 rejections due to incomplete forms and individuals who were not citizens.”

PHOENIX — The Arizona Department of Public Safety has released inspection results of the Tierra Santa charter bus that crashed on Interstate 10 near Sacaton on Friday.

After conducting an inspection of the bus, the DPS Commercial Vehicle Enforcement Bureau has determined both the vehicle and drivers would have been placed out of service for the following:

• The driver would have been placed out of service for not being able to read and speak English sufficiently to converse with the general public;

• Not having a prior seven days record of duty status;

• The co-driver also did not have a prior seven days record of duty status;

• The number of defective brakes is equal to or greater than 20 percent of the service brakes on the vehicle.
